These Terms of Service ("Terms") govern your access to and use of the ATH Insider platform, website, and all related services (collectively, the "Services") provided by ATH Insider LLC ("ATH Insider," "we," "us," or "our"), a limited liability company registered in the State of Delaware and operating in Pennsylvania.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
You must be at least 13 years of age to use the Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
PLEASE READ THESE TERMS CAREFULLY. They contain important information about your legal rights, including a binding arbitration clause and class action waiver in Section 8. By using the Services, you agree that disputes will be resolved through binding arbitration rather than in court.
ATH Insider provides an educational platform that generates estimated NIL (Name, Image, and Likeness) market valuations and revenue share range estimates for college athletes based on publicly available data, reported settlement frameworks, and proprietary position-based modeling.

Important: ATH Insider is not a licensed sports agent, attorney, financial advisor, or professional consultant of any kind. All evaluations, scores, and valuations are estimates only — not guarantees, promises, or professional advice. Actual revenue share contracts, NIL deal values, and program-level allocations depend on individual negotiations, program budgets, athletic department decisions, and NCAA compliance requirements that are beyond our knowledge or control. Before entering into any agreement, consult a qualified sports attorney and/or NFLPA/NBPA-certified agent.
ATH Insider is not affiliated with the NCAA, any university, any athletic department, any NIL collective, or any professional sports organization.
Some features of the Services require you to create an account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@athinsider.com if you suspect any unauthorized access to your account.
ATH Insider offers multiple account types including Free, Athlete, Agent, and Institutional tiers, each with different levels of access and functionality as described on our Plans page.
You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement. We do not knowingly collect personal information from children under 13.
Users registering as agents or recruiters represent that they hold any credentials or certifications required by applicable law for their jurisdiction and sport. ATH Insider does not verify agent credentials and makes no representations about the professional status of any user.
Certain features of the Services are available only through paid subscription plans. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase.
All payments are processed securely by Stripe, Inc. ATH Insider does not store, access, or retain any payment card data. Your payment information is governed by Stripe's privacy policy and terms of service. By making a purchase, you also agree to Stripe's terms.
Subscription fees are billed on a recurring basis (monthly) beginning on the date of your initial purchase. Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features through that date.
All subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us at info@athinsider.com within 14 days of the charge.
We reserve the right to modify subscription pricing at any time. We will provide at least 30 days' advance notice of any price changes via email to your registered address. Continued use after the effective date constitutes acceptance of the new pricing.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

The Services, including all content, features, functionality, design, scoring methodology, algorithms, reports, and underlying technology, are owned by ATH Insider LLC and are protected by copyright, trademark, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, subject to these Terms.
By submitting information through the Services (including athlete profiles, evaluation inputs, and messages), you grant ATH Insider a non-exclusive, worldwide, royalty-free license to use, process, and store that information for the purpose of providing and improving the Services. You represent that you have the right to submit such information.
If you provide feedback, suggestions, or ideas about the Services, you grant us the right to use that feedback without compensation or attribution to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ATH INSIDER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any evaluation output, valuation estimate, or data presented through the Services.
TO THE FULLEST EXTENT PERMITTED BY LAW, ATH INSIDER LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to indemnify and hold harmless ATH Insider LLC and its affiliates from any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, rather than in court. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.
YOU AND ATH INSIDER EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Notwithstanding the foregoing, either party may seek emergency injunctive relief in a court of competent jurisdiction to protect intellectual property rights or confidential information pending arbitration.
Any claim must be brought within one (1) year after the cause of action arises, or it will be permanently barred.
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms or conduct that we determine to be harmful to other users, the platform, or third parties.
You may delete your account at any time by contacting us at info@athinsider.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.
Sections 6, 7, 8, and 10 of these Terms survive termination of your account or these Terms.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date and, where appropriate, by email. Your continued use of the Services after the effective date constitutes your acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ATH Insider regarding the Services and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
